Terms of Service — HawkNest

1. Use of Service

By accessing HawkNest you confirm that you are at least the age of majority in your jurisdiction and that you will use the platform lawfully, for its intended educational purposes, and in compliance with these Terms, any applicable policies, and all laws.

Acceptable Use: You must not interfere with the platform, attempt unauthorized access, or use automated means that burden our systems.
License to Use: We grant you a limited, revocable, non-transferable license to access the service for personal learning.
Access Changes: We may modify, suspend, or discontinue any feature with reasonable notice where practicable.
Compliance: You are responsible for hardware, software, and internet access required to use the platform.

2. Accounts

You are responsible for all activity under your account. Maintain accurate information and keep your credentials confidential.

Security: Notify us promptly of any suspected unauthorized access.
Seats: If you purchase multiple seats, you are responsible for end-user compliance with these Terms.
Termination: We may suspend or terminate accounts for violations. You may close your account at any time; certain obligations survive closure.
Data Retention: We may retain minimal records to comply with law and audit requirements after account deletion.

3. Payments

All fees are shown prior to checkout. Taxes may apply based on your location. Prices are subject to change prospectively.

Billing: You authorize us and our processors to charge your selected payment method.
Subscriptions: Where applicable, plans auto-renew until canceled. You can cancel from your account dashboard effective at the end of the current term.
Refunds: Unless stated otherwise on the course page, purchases are non-refundable once content access is granted, except where required by law.
Chargebacks: Initiating a chargeback without first contacting support may result in account suspension.
Currency: Conversions and foreign transaction fees are your responsibility.

4. Course Content

Course materials, videos, code, and documents are owned by HawkNest or its licensors and are protected by intellectual property laws.

License: You receive a personal, non-exclusive, non-transferable license to access the content for your own learning.
Restrictions: Do not copy, redistribute, sell, publicly display, or create derivative works without written permission.
UGC: If you submit content (e.g., assignments, comments), you grant us a worldwide, royalty-free license to host, display, and improve the service.
Infringement: We respond to credible notices and may remove content or terminate repeat infringers.

5. Liability

The service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, and limit our aggregate liability for claims arising out of or relating to the service to the greater of USD $100 or the amounts you paid to HawkNest in the 12 months preceding the claim.

No Warranty: We do not guarantee uninterrupted or error-free operation, or specific learning outcomes.
Limitation: We are not liable for indirect, incidental, special, consequential, or exemplary damages.
Indemnity: You agree to indemnify HawkNest against claims arising from your misuse of the service or violation of these Terms.
Governing Law & Disputes: These Terms are governed by applicable law of your country of residence, without regard to conflict rules. Disputes will be resolved in competent courts or via agreed arbitration where applicable.
Changes: We may update these Terms. Material changes take effect prospectively after notice via the platform.
